Menstrual Leave for KSRTC Women Conductors: Kerala High Court Calls It a “Serious Issue,” Seeks Govt Stand

Kochi: The Kerala High Court has termed the demand for menstrual leave for women conductors of the Kerala State Road Transport Corporation (KSRTC) a “serious issue,” urging the state government to clarify whether a policy decision in this regard is feasible.

Justice N. Nagaresh was hearing a petition filed by S.S. Asha and a group of women conductors who sought consideration of their representation for menstrual leave. The petitioners highlighted the physical strain of working 14 to 16 hours a day under the double-duty system, arguing that the nature of their job makes such leave essential for health and dignity.

They also pointed out that similar provisions have been introduced in certain state transport corporations, including Karnataka. However, the court questioned whether those corporations were financially stable. KSRTC’s counsel responded that menstrual leave is currently available only in Karnataka and that it was implemented through a government decision.

In its affidavit, KSRTC opposed the proposal, citing severe financial constraints. The corporation stated that it is already struggling to pay salaries and pensions, and introducing paid menstrual leave would impact staff deployment, services, and overall finances. With 2,846 women employees—including 1,842 conductors—granting two days of leave per month would amount to 5,692 additional leave days. KSRTC further argued that menstrual leave is not a fundamental right and that no such provision exists in its current service rules.
