Kollam: The High Court Single Bench has annulled the order obtained by former S.N.D.P. Yogam General Secretary Vellappally Natesan and his associates using political influence from the I.G. of Registration. South Indian R. Vinod, the official general secretary candidate of S.N.D.P. Yogam, said that the High Court’s decision to quash the order of the IG of Registration’s , who took a stand in favor of Vellappally, is welcome. He was speaking to the media at a press conference held in Kollam. The verdict was pronounced by High Court Single Bench Judge Muhammad Nias. The government’s stance on this case will also be crucial.
South Indian R. Vinod mentioned that the stay issued by Gurudevan against Vellappally’s prolonged hooliganism in the Yogam leadership is currently in place. Vellappally had used political influence to obtain an illegitimate order from the I.G. of Registration to regain control of the S.N.D.P. Yogam leadership. The case is based on the fact that proper accounting audits have not been conducted in the S.N.D.P. since 2013. As per company law, this is mandatory for registered companies, failing which the directors become disqualified. The I.G. of Registration’s order, which reviewed the accounts for the years 2014-2015 and 2015-2016 and issued a favorable order for the Yogam, is legally invalid, according to Vinod.
Vinod alleged that the I.G. of Registration fell under Vellappally’s influence to undermine the opposing panel, despite the returning officer declaring them qualified as per the election notification issued by the Yogam. The stay order pronounced by the High Court Single Bench has thwarted the desires of those who colluded with Vellappally. Since 2013, the S.N.D.P. Yogam’s registration was invalidated and the current governing committee disqualified due to the failure to submit accounts in accordance with the Companies Act. The single bench issued a stay order quashing the order made by the Registration IG illegally to validate the invalid registration and disqualifications.
In this case related to the SNDP Yogam, the IG of Registrar had taken a comforting position for Vellapalli and his associates after examining two years of accounting. The High Court overruled this decision in a related case. The case will be reconsidered by the High Court next month, with the government also being asked to provide explanations, making the government’s stance crucial. It is suggested that the Pinarayi government, dissatisfied with Vellappally’s alignment with the BJP, will reflect this in court proceedings. Vinod, who filed the nomination for the general secretary position against Vellappally in the S.N.D.P. Yogam elections, will be able to assume the general secretary role if Vellappally and his associates are disqualified in the legal battle. The argument regarding the lack of a DIN (Director Identification Number) against Vellappally is also under court consideration, and the High Court’s stay order on the I.G. of Registration’s order will be decisive.
The High Court Single Bench stayed the I.G. of Registration’s order in a case filed by South Indian R. Vinod, the official general secretary candidate of the S.N.D.P. Yogam. Advocate Ramkumar filed the petition in the High Court on behalf of R. Vinod. Previously, Vinod had also obtained a stay from the High Court against a commission appointed by the government. The panel competing with South Indian R. Vinod includes D. Rajeev as the president candidate, Arun Mayyanad as the vice-president candidate, and Mithun Sagar as the Devaswom secretary candidate.
